- Digital Content: Data produced or supplied in digital form, or integrated into goods.
- Consumer: Natural person acting outside their trade, profession, or business activity.
- Contract: Sales agreement formed via the website or electronic communication.
- Distance Contract: Contract concluded without the parties being physically present together.
Scope and Applicable Law
These General Terms and Conditions govern the main rules of ordering, contract formation, delivery, payment, invoicing, consumer rights (including withdrawal), warranty, and complaint handling related to the webshop operated at www.liftyofficial.com.
The contract is governed by Hungarian law and relevant European Union rules, in particular consumer protection and e-commerce regulations, as well as the General Data Protection Regulation (GDPR, (EU) 2016/679).
Contract Language and Form
The primary contract language is Hungarian. Contracts concluded via the website are not stored as individually signed paper contracts, but order and invoice data are retained as required by law.
Prices and Payment
Product prices displayed on the website include the applicable taxes and charges based on the customer’s country of delivery and billing. The final payable amount, including any delivery costs, is shown during checkout.
The Seller may adjust prices in the webshop, but such changes do not affect already confirmed orders. In case of obvious pricing errors (for example, prices shown as zero or clearly unrealistic), the Seller may cancel the order and offer purchase at the correct price. In this situation the Buyer can decide whether to accept the corrected price or withdraw the order.
Available payment methods (e.g. bank card via Stripe, cash on delivery where offered) are always indicated during the checkout process and may vary by country.
Delivery
Delivery is handled by Packeta Group or its partners. Exact delivery options, estimated time and fees depend on the destination country and are displayed at checkout before the order is placed.
Unless otherwise agreed, the Seller delivers the ordered Goods within a maximum of 30 days from the conclusion of the contract. If delivery is delayed, the Buyer may exercise the rights granted by applicable consumer and civil law.
Ordering Process
- Browse the webshop and select the desired Goods.
- Add products to the cart and review the cart contents.
- Provide billing and delivery details, and choose the payment and delivery method.
- Check the summary page and confirm the order by clicking the order/checkout button.
Placing an order via the website is considered an offer by the Buyer. The contract is created when the Seller’s confirmation email becomes available in the Buyer’s email system within a reasonable time (no later than 48 hours). If confirmation does not arrive in this period, the Buyer is no longer bound by the offer.
Right of Withdrawal (Consumers)
Consumers (natural persons acting outside their trade/profession) have the right to withdraw from the distance contract within 14 days without giving any reason. The withdrawal period generally starts on the day the Consumer or a third party designated by the Consumer takes possession of the Goods.
To exercise this right, the Consumer must send a clear declaration (e.g. email) within the deadline. The Consumer bears the direct costs of returning the Goods, unless the Seller expressly agrees to bear these costs.
The Seller will refund all payments (including the standard delivery cost, if applicable) within 14 days from becoming aware of the withdrawal, but may withhold the refund until the Goods are returned or proof of return is provided.
The right of withdrawal does not apply in certain cases, for example personalised products, sealed hygiene items opened after delivery, or digital content that has already been fully accessed or downloaded with the Consumer’s prior consent.
Warranty and Liability
The Seller is responsible for providing Goods that conform to the contract and applicable law. Consumers may exercise statutory rights in case of defects, such as repair, replacement, price reduction, or contract termination under the conditions set out in Hungarian and EU law.
Some durable products may be covered by mandatory guarantee rules. The details of these rights and procedures are based on the relevant civil, consumer protection and sector-specific regulations.
Complaints and Dispute Resolution
The Buyer may submit complaints or questions regarding the Goods or the Seller’s conduct via:
- Email: info@liftyofficial.com
- Postal address: 2360 Gyál, Katona József utca 16/A, Hungary
- Phone: +36 70 614 3155
The Seller will respond to written complaints within the legally prescribed time limit and keep related records as required. If the dispute cannot be resolved directly, Consumers may turn to:
- the competent consumer protection authority,
- the competent Conciliation Board (Békéltető Testület),
- or the competent Hungarian court.
Copyright
The content, design and texts of the website are protected by copyright. Any reproduction, modification, or further use without the prior written consent of the rights holder (Barta Viktor E.V.) is prohibited, except as permitted by mandatory law.
Final Provisions
If any provision of these Terms is found invalid or unenforceable, this does not affect the validity of the remaining provisions; such clauses shall be replaced or supplemented by the applicable statutory rules.
The Seller may update these Terms occasionally. The version published on the website at the time of ordering applies to the contract.
